1. Acceptance of Terms

By downloading, installing, or using HairMaxx ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Entertainment Purpose Only - Medical Disclaimer

HairMaxx is designed purely for entertainment purposes. The App:

• Does NOT provide medical advice, diagnosis, or treatment
• Does NOT replace professional medical consultation
• Generates scores and results that are for fun only
• Uses AI that may produce inaccurate or inconsistent results
• Should NOT be used to make any health-related decisions
• Is NOT a medical device and has NOT received regulatory approval

⚠️ IMPORTANT: Always consult a qualified healthcare provider, doctor, or dermatologist before making any decisions related to hair loss or any health concerns. This app should be used in addition to, and never as a replacement for, professional medical advice.

3. No Medical Claims

The App makes no claims regarding:

• Accuracy of any analysis or scores
• Ability to detect, diagnose, predict, treat or prevent any medical condition, including hair loss
• Scientific validity of any results
• Effectiveness of any tips or suggestions provided

All features are for entertainment and should be treated as such.

4. User Responsibilities

By using the App, you agree that:

• You are at least 13 years of age
• You will not rely on the App for any medical decisions
• You understand results are entertainment only
• You will seek professional advice for any health concerns
• You will not misuse the App or its features

5. In-App Purchases and Subscriptions

HairMaxx offers two ways to get AI scans through the App Store, at the prices shown in the app before you buy:

• Single Scan: a one-time purchase for one scan. It does not renew, and each additional scan is a new purchase. One-time purchases can't be restored, and an unused scan is lost if you delete the app.
• Daily Scans: an auto-renewable monthly subscription that includes one scan per day. Unused daily scans don't carry over to the next day.

By making a purchase, you agree that:

• Payment will be charged to your Apple ID account at confirmation of purchase
• The Daily Scans subscription renews automatically each month at the same price unless it is canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours before the end of the current period
• You can manage or cancel your subscription in your App Store account settings (Settings > your name > Subscriptions). Canceling stops future renewals; you keep access until the end of the period you paid for
• A scan is used only when an analysis completes successfully; if an analysis fails, you keep your scan and can retry
• Refunds, where eligible, are issued by Apple; request one at reportaproblem.apple.com

Your use of the App is also subject to Apple's Licensed Application End User License Agreement.

6. Privacy

Your use of the App is also governed by our Privacy Policy. Key points:

• Your photos and questionnaire answers are sent securely to Google's Gemini AI only when you start a scan, and are not stored on our servers
• Your scan results, scan photos and answers are saved on your device until you delete them with Clear All Data in Settings
• Data is transmitted securely via HTTPS

7. Intellectual Property

All content, features, and functionality of the App are owned by HairMaxx and are protected by copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind. We do not warrant that:

• The App will be error-free or uninterrupted
• Results will be accurate or reliable
• The App will meet your expectations

9. Limitation of Liability

To the maximum extent permitted by law, HairMaxx shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.

Under no circumstances should you make health decisions based on this entertainment app.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
